Property transfer tax in Spain

property transfer tax in spain

When purchasing a property in Spain, one of the most critical costs for international buyers is the Property Transfer Tax, known locally as Impuesto de Transmisiones Patrimoniales (ITP). Understanding this tax is vital for accurate financial planning, as it is a significant upfront expense that varies depending on the property’s location and status.

What is ITP?

ITP is an indirect tax applied to the purchase of resale (second-hand) residential properties. It is the buyer’s responsibility to pay this tax.

It is important to distinguish between property types:

  • Resale Properties: These are subject to ITP.
  • New-Build Properties: These are typically subject to VAT (IVA) at 10%, plus Stamp Duty (AJD), rather than ITP.

How is ITP calculated?

The tax is calculated by applying a regional percentage to the “taxable base” of the property. Since 2022, this base is determined as the higher of the declared purchase price or the official Valor de Referencia (Reference Value) assigned by the Spanish Cadastre.

2026 ITP Rates by Autonomous Community

ITP rates are set by each autonomous community, leading to significant regional variations.

The following table provides the general rates for 2026.

Please note that many regions offer reduced rates for specific groups, such as young buyers, large families, or purchases of primary residences, which may differ from the general rate listed below.

Autonomous Community General ITP Rate (2026)
Andalucía 7%
Aragón 8% – 10% (progressive)
Asturias 8% – 10% (progressive)
Balearic Islands 8% – 13% (progressive)
Canary Islands 6.5%
Cantabria 9%
Castilla-La Mancha 9%
Castilla y León 8% – 10%
Catalonia 10% – 13% (progressive)
Ceuta 6%
Madrid 6%
Murcia 8%
Navarre 6%
País Vasco 7%
La Rioja 7%
Valencian Community 9% (from 1 June 2026)
Extremadura 8% – 11%
Melilla 6%

Note: In the Valencian Community, the general rate was reduced from 10% to 9% for properties valued up to €1,000,000, effective from 1 June 2026. For properties exceeding €1,000,000, the rate remains 11%.
