Identifying an Estate Agent

Pre-sale – selling a property in Spain

Prior to finding a buyer, it is a good idea to ensure that all relevant documentation is in place.

This will save time once you receive an offer and will show prospective buyers that the property is free of complications, with a dedicated vendor.

Power of Attorney to avoid having to travel

Many clients do not wish to travel to Spain to complete the sale of their property.

In these circumstances, a Power of Attorney would be drafted for signature in front of a notary in the client’s home country.

GB Abogados also offer this as a stand alone service, so if you wish to give Power of Attorney to an individual in Spain, we can assist.

Acceptance of Offer

Offers to purchase will normally be placed via the estate agent.

However, we are happy to assist in negotiations if required.

The prospective purchaser’s solicitor is likely to request a copy of the nota simple and carry out land registry checks prior to deposit payment.

Purchase Contract

We will draft a purchase contract and agree the terms with all parties. Upon signing of the document, we will ensure that the deposit is paid to protect your interests.

Notary Signing

The completion of the transaction is confirmed at a notary signing in Spain.

This is usually at a notary office close to where the property is located.

We will attend the notary signing, either with you or with Power of Attorney. The notary appointment will typically take around 2 hours.

Sale Proceeds and Taxes

GB Abogados will ensure that all monies are correctly accounted for. We can assist with the transfer of funds back to the UK, including competitive currency exchange rates.
