Requirements and Legal Deadlines for Cancellation
To apply for the cancellation of a criminal record, the conditions established in Article 136 of the Spanish Penal Code must be met:
- Extinction of the Sentence: The imposed sentence must have been fully served, which includes any substituted measure such as imprisonment, fines, or community service.
- Satisfaction of Civil Liability: Any court-ordered compensation must have been paid, or this liability must have been declared prescribed (legally lapsed).
- Completion of the Legal Waiting Period without Reoffending: The applicant must not have committed a new crime during the legally established period, which starts counting from the day after the sentence was extinguished.
The legal waiting period varies depending on the severity of the conviction:

The Application Process

- The applicant’s identity document (DNI, NIE, or passport).
